Anvil Hill mine work halted amid approval doubts

CONSTRUCTION at the Mangoola mine at Anvil Hill has been stopped indefinitely, as doubts emerge about whether Xstrata Coal had proper approval to begin work.

Muswellbrook Shire Council has effectively claimed that Xstrata was breaching its conditions of consent when construction began at Mangoola earlier this month.

Mayor Martin Rush believes the council did not give Xstrata approval to start work ahead of schedule, despite councillors indicating their support to do so in November.

The Department of Planning gave the council the power to approve completion of road works on Wybong Road East and a Construction Traffic Management Plan that had to be put in place.

The roadworks are not due to be finished until April, and the council has asked Xstrata to submit a new traffic plan, after concerns were raised about traffic using Wybong Road West until the upgrade is finished.

Cr Rush rescinded the council's motion of support earlier this month, after a contractor was killed in a collision with an oversized truck carrying construction equipment to the mine along Wybong Road West.

Xstrata Coal did not respond to a request for comment this week, but said last week the company was "working with the council" to resolve traffic issues at the site.

The council rejected a new traffic plan earlier this week, and asked Xstrata to supply a third draft of the plan by next month.

Contractors due to begin working at the mine site have been told they will not start until at least mid-February.

Having last week attacked the council for supporting Xstrata, Wybong Action Group spokesman John Shewan said he believed no approval had been given for work to begin.

"In review [the group] now applauds the immediate action taken by [Cr] Rush to clarify to Xstrata that they did not have Construction Traffic Management Plan approval from council," Mr Shewan said. He called for a coronial inquiry into the contractor's death.

Everything was fine with council until someone was killed and then to take the off themselves council pulled the rug. Just another policy written in blood that is wait until someone is either killed or injured before doing anything about it.Scuttle behind doors council so no one can point the finger at you.

This is where Cr Osbourne and his greenies should be. Blocking the trains after the coal is dug is like putting new tyres on a rusted car in a wrecking yard. Coal should not be dug untill all the conditions of consent are in place and 100% met.

I find it quite funny that many people cry and moan about coal mining. i think you will find that most if not all coal mines operate within the laws of the govenment, a govenment that many people elected and now i have a question on this hot day, how many people turned on their air conditioner today ? and where did that power come from, how many people watched t.v, and where did that power come from, and how many people had a cold drink and where did that power come from ? mmm i think you will find it came from coal !!!

We are reading over time in the Nwewcastle Herald that Xstrata did not have Construction Traffic Management Plan approval from council. It may be that if this is identifed as a mining death a special coronor will look into it. The underlying concern is if it was no approved what is the insurance position who will be rsponcible for any claims which flow down from this death? Edward James
