Belmont cake shop fined $1300 over gluten-free indiscretion

10 Oct, 2009 04:00 AM
A LAKE Macquarie cake shop has been fined more than $1300 for selling gluten-free cakes that were not gluten free.

Belmont Specialty Cakes in Belmont Citi Centre was fined $1320 by the NSW Food Authority for selling gluten-free friands on April 8 this year that actually contained gluten.

Gluten is a protein found in wheat, barley, oats and rye that is harmful to people with gluten intolerance or coeliac disease.

The genetic disease can cause serious problems in the stomach and intestines, and if left untreated can mean people do not absorb their food.

The owner of the cake shop, listed as Jackie Tram Pty Ltd, was also fined $660 for failing to take all necessary steps to prevent the likelihood of food being contaminated during processing on April 14 this year.

A NSW Food Authority spokesman said the authority had responded to a complaint by a customer who had asked for gluten-free food and had a reaction to one of the offending friands.

Authority officers bought a sample of the advertised gluten-free foods and sent them to a laboratory for analysis, which came back positive for gluten and resulted in the fine.

"We do regular surveys of category items and did a gluten-free survey late last year, which was very successful," he said.

Belmont Specialty Cakes' owner declined to comment.

The information was listed on the NSW Food Authority's website as part of a policy of naming and shaming.

Hmmm, glad to see them punished, although rather mildly. I AM however saddened that this was written: "...The genetic disease can cause serious problems in the stomach and intestines, and if left untreated can mean people do not absorb their food." I hated to see that written because it unintentionally downplays the seriousness and us Celiacs already have to deal with a world of "normal" people thinking we're hypochondriacs! Celiac can indeed cause serious problems and improper nutrient absorption, but if left untreated can cause various AutoImmune diseases, stomach cancer or liver failure.

Linda, its not only the damage Coeliac Disease causes to the lining of the stomach, but the effect it can have on the person suffering the attack, especially if they are super-sensitive. I speak as the person that purchased the contaminated product for my wife.

I am thrilled to read that Celiac Disease and gluten-free food is taken so seriously in your country. Here in the USA, we are way behind you in public recognition and government acknowledgment.

As a coeliac, I am encouraged that improper labelling is being taken seriously bu the Food Authority. Nothing worse than being told something is gluten free and finding out the hard way that it is not.

Now this shop also needs to attend a course on food preparation, handling and labelling. Why aren't the Tafe's running this type of education. What about those who also have allergies that cause anaphylaxis. David H thank-you for taking this further after your wife got sick from the contamination. As one who has no reaction (silent coeliac) I would not know if I had been contaminated, to make a complaint.

Regardless, they make damn fine sausage rolls. Not gluten or fat free, but good anyhow. I will continue to shop there as I couldn't care less about the vast minority who are gluten intolerant.
