Gas control plan foiled

UPPER Hunter communities hoping for more local government control of the coal seam gas industry are disappointed by Singleton Council’s draft planning laws.

The draft shows how dominant state laws negate elected councillors’ efforts to contain the industry.

Late last year Singleton councillors voted to prohibit coal seam gas in four locations, including Broke and Bulga and subject the industry to council consents.

The draft proposes to prohibit the industry from operating in four new land zones; primary production small lots, rural landscape, environmental management and environmental living.

But council staff warn it is likely the Department of Planning will direct the council to remove this provision.

Coal seam gas developments are state significant development under new laws that came into effect on October 1 and replaced the discredited Part 3A provisions.

Councils are not consent authorities for significant developments under the new system either.

‘‘Any prohibition on coal seam methane gas development will have no legal effect in the draft LEP [local environmental plan],’’ the council draft stated.

Hunter Valley Protection Alliance president Graeme Gibson said the government pledged to get rid of Part 3A but its effects lingered.

‘‘The council’s resolution was firm but its hands are tied,’’ Mr Gibson said.

The council has sent its draft LEP to the NSW Government for approval to put on public exhibition. It is expected to be on exhibition in February for two months.

The plan is Singleton Council’s response to a 2005 NSW Government directive to all councils to revise their planning laws in a standard format.

The Department of Planning declined to comment.

LG Councillors are elected by their peers. Their intellectual capacity to administer LOCAL "matters" pertaining to LAND, is exactly why the Founding Fathers in the Federated system of Constitutional independent and interdependent governments mandated that the LEGAL FRAMEWORK for all FREEHOLD SHALL rest with LG so as to keep Parliaments and Party Politics away from "local' administrative LAND matters. All an elected Council needs to do is tell the State where to go. States have no jurisdiction over the administration of the freehold (private property). Know your RIGHTS. DEFEND THEM NOW!

No Graham Gibson....Councils' hands are NOT tied. That's the convenient lie.

The freehold landuse law has been settled 800 years. RATEPAYERS own what the Crown sold; Registered: and Conveyed in the[Deposited Plan].

Most MPs are no better than card sharks at a rigged casino table.

But a LOCAL Council has all the cards; LG holds all the freehold aces. Has suit and trumps. Local Councillors are seeable and touchable.

The State bluffs only because LG allows it. Stand up to be noticed: speak up to be heard; and then see the difference.

The government still supports outdated energy sources that are proven to be more harmful than being beneficial. Rest of the developed world solved their pollution problem by switching from coal to LNG. They overwhelmed energy shortage by nuclear power stations, achieved economic progress via lower energy cost, high productivity. Australia has rich LNG resources, to be explored and exported!. Australia has rich uranium resources used by other countries' nuclear power stations. We are still in 1970s and not using our own clean energy sources, but offering to the benefit of other countries.

Gasland is a bunch of propaganda rubbish. Rather than trying to argue it with only 600 characters if you can spare 15 minutes and can ignore the cheesy American accent, have a listen to the link below. If you're on the Gasland band wagon, you definitely should.
