Judge warns of warrant for Commissioner

NEWCASTLE District Court Judge Ralph Coolahan said he would issue a warrant for the NSW Police Commissioner's arrest on Monday if a police officer does not provide information to lawyers involved in a trial.

Judge Coolahan gave the warning while discussing pretrial issues yesterday with a prosecutor and a defendant's barrister.

The trial is one of several listed at Newcastle in the coming weeks.

The court heard that a relatively inexperienced female general duties officer had not provided information to defence lawyers.

No reason was given as to why the officer had not co-operated.

If the material was not forthcoming, Judge Coolahan said he would issue a warrant for Commissioner Andrew Scipione's arrest on Monday so Commissioner Scipione could be brought before the court to explain why.

Judge Coolahan said he didn't know if the officer valued her career, but he didn't think it would do her any favours if the Commissioner faced court to explain her actions.

Who is the bully here I would have thought the warrant should have been to the officer involved not the Commissioner.

Typically ineffective judicial posturing and grandstanding - Ralph just wants the crim to show up so he can let him off, and see him next week for the latest serial offence. Your tax dollars at work.

How the hell does the Commisioner know what the hell the female Constable has done, there are 17,000 officers is NSW! If he was truly 'fair-dinkum' as Gary said, them he would begin by stopping all of the junkies and scum of the earth crooks getting out on bail.

NEWCASTLE District Court Judge Ralph Coolahan has run out of patience, and rightly so. If NSW Police charge a person or persons with an offence; the rules are evidence is presented to the defence to see what actually police are alleging. I cannot believe people have a problem with that. The rules apply to everyone in this country Australia is not a fascist state. i.e. advocating an authoritarian hierarchical government (as opposed to democracy or liberalism)

You're kidding Tiger, there would be hundreds lining up for that one! Seems to me symptomatic of poor training and high staff turn over since the Academy turned into a sausage factory. The Buck stops with the Commissioner so he should front Court and explain. Not that he'd know anything about street Policing or brief preparation!

I think this may have something to do with contempt of court. If so, please keep us informed Herald. Some think that by not presenting paperwork hearings can be deferred indefinitely.
