Man fined for downloading Simpsons cartoon porn

A MAN pleaded guilty yesterday to possessing child pornography after he downloaded images of characters from The Simpsons and Pokemon naked and performing sex acts on each other.

Glenn Phillip McGuire, 28, had originally pleaded not guilty after police found six such images of the cartoon characters on his computer.

The images had been doctored or drawn by unknown people and were downloaded while McGuire was surfing the Limewire website.

The Supreme Court ruled last December that child pornography can include sexually explicit images of cartoon characters.

McGuire changed his plea in Newcastle Local Court yesterday to guilty and was convicted, fined $1000 and put on a 12-month good behaviour bond.

The Supreme Court ruling came after a man was convicted in Parramatta Local Court in February last year of possessing pornographic images of child cartoon characters.

Justice Michael Adams agreed with the local court magistrate that the images could be classed as child pornography.

That ruling extended the legal definition of "person" to include cartoon characters.

Police searched McGuire's home in April last year and seized his computer and disks before charging him.

The case was delayed to await the Supreme Court's decision.

Defence barrister Mark Preece told the court yesterday that McGuire, of Renfrew Crescent, Edgeworth, received the images "mischievously" while downloading music and video files from Limewire.

"It's the sort of spam email garbage that is disseminated all around this country every day," Mr Preece said.

"The images are at the extreme lowest end of the scale.

"He's extremely embarrassed about the nature of the charge.

"To say that this is a very unfortunate matter is probably a gross understatement."

Magistrate Sharon Holdsworth said that even though the images did not depict actual children being exploited, the need remained to deter members of the community from viewing or disseminating such images.

"There have been rather extraordinary circumstances in this case," she said.

"It was both necessary and appropriate to await the Supreme Court decision."

This is stupid. Magistrate Sharon Holdsworth needs to issue an order removing copies of "The Simpsons Movie" from every video store and personal DVD collection. The film contains a scene in which Bart skateboards naked. In one part of the scene, Bart's "nether regions" are clearly shown. He is then chained to a pole in full view of everyone. I'm against Child porn as much as the next guy. In fact I have personally known two Hunter Valley pedophiles whose conviction for downloading child porn images ended up on the front page of The Herald. My friendship with these two men and their lies makes me quite unsympathetic to anyone who downloads child porn images. But what about Glenn Phillip McGuire? (I have never met him) He is NOT a pedophile. He did NOT download child porn - or else EVERYONE WHO OWNS THE SIMPSONS MOVIE OWNS CHILD PORN. This is ridiculous.

How the hell is that child pornography? No child was viewed in a pornagraphic way. No one was harmed. He probably got a good laugh. Come on courts, lets be serious and stop wasting time in silly matters like this.

This is as sick as it is ridiculous. Cartoon characters are not children, they are not people, they are drawings. No one was exploited in the making of them, except potentially the copyright holder of the characters. The only purpose of child pornography laws should be protecting real flesh and blood children from exploitation by stopping photos being produced and by punishing those who create a demand. However all this ruling does is further dilute these laws, making a farce out of the legal concept of child pornography and starting us down the road following America, where a sexual predator could simply be someone who urinated on a public tree for lack of restrooms.

This is beyond rediculous. When a pencil and a piece of paper, or a screen and some pixels can create an image which is not a photograph, does not demean or create a victim of anybody, is then held as a criminal and liable offence. Australia has once again become a penal colony, where police may search your homes, your cars, the government can spy on citizens, block access to content. We should be ashamed of ourselves, this country used to be a free and very democratic society and now you cant go anywhere or do anything without having a restriction. Driving, Fireworks, Sports Shooting, Archery, Search and Seizure, Terrorist Laws, XRay Scans, Drug and Chemical Scans, CCTV, we could go on and on here. We are not criminals, we are people who want the freedom to enjoy and get on with our lives. Australia should learn from its forefathers, whom grew from a prison based society. Its such a shame this generation in power are taking us back there. Australia, Policed State, Australia the new Penal Colony.

Yet another example of 'MORAL ABSOLUTISM'. Why aren't they going after the real crims? I was the unfortunate victim of a false arrest and malicious prosecution and fortunately my charges were dismissed after the cops arrested me for having LEGITIMATE porn on my computer! I could prove the ages of the people depicted, but it did not stop the 'keystone kops' from arresting me and destroying my life. Well fellows, it's my turn now! Should have dotted your i's and crossed ALL your t's because you violated my human rights. Lets see if the magistrate who hears my Tort against the Federal Police has the same views as you do!

The simpsons images have been around for EVER, I think I may have seen them as a kid many, many years ago. Personally I do not feel crude drawings and illustrations are child pornography. Boy you all seem to have some ever increasingly strict rules over there in AU!
