Newcastle councillors slam 'gag' policy as censorship attempt

CIVIC leaders have slammed a new policy governing their conduct, saying it amounts to censorship because of a "gag provision" restraining comments made to the media.

Councillor Michael Osborne fears that Newcastle City Council's proposed revisions to its code of conduct will inhibit elected representatives' communication with the community.

"It's a gag provision," he said.

"It's trying to fetter the role of councillors."

Most councillors voted last night to put the draft code on public exhibition for 28 days.

Cr Osborne and colleagues Aaron Buman and Mike King did not support the decision.

Many councillors, including those who voted to seek public comment, had concerns about some provisions, especially a section on talking to the media.

The rules state that councillors are free to make personal statements to the media, but warns this must not include criticism of council officials, and suggests any criticism of the council's decisions would damage its credibility and unity.

The proposed code also dictates that councillors must give the administration's media officer a copy of statements given to the media.

"I think it's gagging us," Cr Buman said.

"And if I reflect back to the last council and its performance I spoke out a lot of the time about a lot of the decisions I was in the minority about.

"I wanted the general public to know how I felt."

Cr Nuatali Nelmes also expressed concern.

"I think it does need to be changed because I don't necessarily think the intention is censorship," she said.

"But I think when it's in black and white like that, that could be the end result."

Lord Mayor John Tate said he was comfortable with the rules.

"It doesn't fetter councillors' rights," he said.

Consultant Kath Roach told last night's council meeting that some provisions were based on the Department of Local Government's model code, but others were not.

A council spokeswoman said general manager Lindy Hyam declined to comment.

Can nobody rid the City of this plague? Newcastle, on the Harbor. Home of the McCloyscape, the Pasha Bulka memorial to NCC, untold vandalism, graffiti, alcohol and violence. A truly squalid place to live.

The State has a perfectly reasonable Model Code of Conduct in place, designed to avoid waste, duplication and inappropriate conduct by Council Administrations. Councillors are elected to represent the community and sometimes it is important to highlight problems in the media that cannot be resolved internally. Examples are the waste of $23 million on moving the museum, and failure of administrations to properly manage their finances and organisation to community standards. This is a democracy and if our elected representatives are wrong they will be punished at elections.

giving councilors the right to politically grandstand is similar to giving kids shotguns, except they can do more than just shoot themselves in the foot. A town council is there to administer a town - not grandstand the political aspirations of its councilors. If they want to spread a manifesto -they should write a book, not use ratepayers time. They are there to provide representation to the needs of the rate payers.

So can someone tell us when democratically elected officials lost their democratic right to voice the concerns of the people they represent? This is a farce and I hope councilors don't fall for it.

Its GAGGING alright,this kind of rule comes in only if the council's do have something to hide,as the public who pay rates and vote for some of these monkeys,we have every right in the world to be informed of positive and negative matters within council walls,are we heading into a fascist revolution?

Talk about Big Brother - whoever put this document together would have achieved stardom in any foreign country that demand total silence on any issue that would inform its citizens of the truth about failures, problems and deficiencies in both administration and government (read council). It is interesting to note that the total document does not reflect the model code of the department - if the Departrment considered some of the additional points relevant and essential they would have included them for the benefit of all councils in NSW. Does it also include a provision preventing the GM from commenting on policy issues that are not within her command and the responsibility of the elected council? The big question remains who instructed the consultant to include these points in the document - The LM or the GM. Me thinks something stinks in the town of Newcastle.

"..fears that it could damage council's credibility and unity" - this statement implies that NCC has some degree of credibility and unity - a statement that is clearly false.

Why does the council need to employ a "consultant" on this matter... what a shocking waste of ratepayers money.
