Release Tillegra memo: ex-judge

A SECRET Tillegra Dam memo that Hunter Water has tried to keep under wraps should be made public, a retired Supreme Court judge has found.

The water authority had claimed legal privilege over the memo, which was sent from general manager Kevin Young to senior staff in the office of then water utilities minister David Campbell on September 29, 2006.

Retired judge Sir Laurence Street, who was commissioned by the upper house of Parliament, the Legislative Council, dismissed the privilege claim, saying the public interest outweighed the commercial concerns and recommended it be made public.

That advice was given last January 20 but the memo was not released and Sir Laurence's recommendation was kept secret until Wednesday night, when the Greens won a motion to have it released.

It came in a tumultuous night for the Government in which the Shooters Party voted against Labor on pieces of legislation and motions put by other parties.

John Kaye, of the Greens, said the Government's decision to stop Parliament a day early, adjourning to September, had stopped the further release of the memo.

"The Government has shut down Parliament to avoid a number of embarrassing outcomes, one of which would be us getting the documents on Tillegra," Mr Kaye said.

The memo was among a box of documents produced in the upper house but not made public, because of the privilege claim.

Sir Laurence concluded the memo should be released in order to contribute to an informed public debate about any need for Tillegra Dam.

Mr Kaye said it fell to Mr Young to say why the memo should not be released.

Mr Young said yesterday his hands were tied.

"Hunter Water must respect the processes of parliamentary privilege, so at this stage I am unable to comment," he said.

"As I always am, I would be happy to comment once the parliamentary process is concluded."

Come on Mr Young give us a good reason why this dam is to be build - if you can find one & get your cronies at State Gov to release all relevant doc's. the public are awake to you & state gov's antics & its about time you came clean. This was shoved at you by a state gov in trouble - so stop taking the blame & let them take the wrap

What a disgrace. It is hard to hide the "truth" forever when the need for this Tillegra Dam is just a lie. What does the 29 Septemeber document say? You bet it does not recommend a dam. Why else would Kevin Young's article in the Newcastle Herald in October 2006 state there was no need for the dam? You may treat Dungog people with contempt, but as you stated Mr Young, "we live in a democracy"

Come on Nathan Rees stop keeping us in the dark and feeding us bullshit. Hunter water storages are full and overflowing. Why should we pay for a dam we don't need that has gone from $300m to $447m. The cost of the dam is rising faster than our current full water supply. Give us the truth about Tillegra Dam - we don't want it, we don't need it - so give it up as a bad decision.

I have read on numerous occasions a call for a parliamentary enquiry into Tillegra and nothing happens. Now we have a retired judge suggesting there is a need for the public to know. Mean while Hunter Water continue to do what they do best and use parliamentary privlege to obfuscate the need to tell the truth.

I suspect that the recommendation is that the dam not be built otherwise this report would have been released a long time ago.

Absolutely disgraceful! The sooner this Labor Government is kicked out the better. They have no respect for the wishes of the people of this state. We say "no" to Tillegra Dam. We don't want it, we don't need it, and we don't want to pay for it.

This whole sorry story seems to have forgotten about those poor people of the Williams Valley who have had to bear the brunt of this Govt's dictatorial and jack boot behaviour. Where is the democracy when Hunter Water threatened those landholders to sell now or face the threat of compulsory acquisition. And what about all those families whose relatives are buried at the still operating Munni Cemetery? The threat of exumation or inundation by dam waters is just too horrid to contemplate. Come on Mr Rees, come up with a better answer to the so called drought proofing of the Hunter, when it is not needed.

Labor should once again hang their heads in shame - they are deliberately trying to deceive the people of NSW, and particularly the Hunter - the ones who have to pay for this mess.
