Teen in anguish paid out

HE turned to drugs, alcohol and crime in the wake of a horror Coalfields car smash where friends and family were killed and seriously injured, but yesterday his future looked brighter.

The teenager, who cannot be identified, won a payout from Belinda Duncan, the woman who inflicted so much pain and anguish when she crashed a car full of young people after reaching speeds in excess of 200km/h.

Duncan, who is serving a 12-year sentence for causing the double fatal, was ordered yesterday to pay the teenager an undisclosed sum for the psychological trauma she inflicted.

She did not attend Newcastle District Court.

The teenager was a friend and relative of some of the occupants of the Mitsubishi Verada when it left Duffie Drive near Cessnock in the early hours of October 7, 2009.

Jayde Duncan, 13, and Cassandra Ford, 15, died instantly while three other passengers suffered horrific injuries, including two who lost limbs.

Some of the young relatives and friends of the victims settled their claims against Belinda Duncan last year.

The settlements included money for future counselling and psychological treatment.

The teenager who settled his case yesterday, however, was forced to wait after Judge Margaret Sidis said she was concerned about his behaviour after the crash.

She was told last July he had turned to drugs and alcohol and had committed crimes after the crash, but yesterday the court heard he had since turned his life around.

Judge Sidis ordered that a sum of money, which was not disclosed, be deposited into an account for his future education and welfare.

Judge Sidis said it was clear that the teenager had suffered severe psychological trauma arising from the crash, but he had since recovered.

Duncan pleaded guilty to two counts of manslaughter and three counts of dangerous driving occasioning grievous bodily harm.

She was sentenced in February last year to 12 years and six months’ jail with a non-parole period of eight years.

She will be eligible for parole in 2019.
